By commissioning me, you are stating that you have read and agreed to these terms.
Basic ToS:I as the artist, reserve the right to deny ANY commission for any reason, if I decide I can no long complete a commission, you will be refunded based on the amount of work completed. Read below for clarification.FOR SKEB COMMISSIONS: You give me character(s), I draw them, I give the finalized skeb com back to you the client and if any character details are wrong or any visual errors they will be fixed. Other than that no revisions for skeb style coms.BY ORDERING ANY NSFW/18+ ART YOU ARE AGREEING THAT YOU ARE 18 OR OLDER.
MY WORK CANNOT BE USED FOR AI GENERATORS OR NFTs.In Depth ToS:SECTION I. IMAGE COPYRIGHTI, the artist, retain full and exclusive rights to the original artwork. The client may not claim it as their own.Conditions for Reposting
The client has my permission to repost the artwork wherever they would like, as long as proper credit is given (a link back to my X or vgen, or my @ on X) If you do not want me to post your commission online in the form of WIPS, or if you want to post the final product first for any reason, you must tell me when you order and we can discuss terms for that in dms!If used for commercial merchandising an additional +100% will be added onto the price of the commission. This will only apply to art commissions that are being sold as merchandise, and not work for commercial digital use like streaming or promotional material. If I do find you use my work for commercial merchandising without proper payment, I reserve the right to file a DMCA and/or take legal action. You will also be placed on my blacklist, and will no longer be able to commission me in the future.Prohibited ActionsClaiming the artwork as your ownAltering the artwork in ways that would make it unrecognizable from the original work (I.E: feeding my work into AI, or giving it to another artist without previous permission to change aspects of the original image)Using work for commercial merchandising when that has not been paid for.If these terms are broken, you will be blacklisted from commissioning me in the future, as well as I, the artist, reserve the right to file a DMCA claim and/or take legal action.SECTION II. REFUND POLICYIf the commission is canceled (by me or the client) before work has started, then the client will receive a full refund.If the client cancels the commission during progress, the amount refunded will be on a case-by-case basis and up to the artist’s discretion. Line and Flat Color: 10%No refunds will be given for completed or nearly completed commissions.I as the artist, reserve the right to cancel a commission at any time, for any reason, and without explanation. But as stated previously, If I the artist am unable to complete the commission and need to cancel a full refund will be given regardless of completion statusSECTION III. CONTACT AND COMMUNICATIONMost of my communication is done via Twitter DMs, and Vgen. However if you need to contact me elsewhere you can do so via my discord (callestmebekky) if needed. Once a commission is completed, I will send the final product(s) to the commissioner in a zip folder.Visual Reference Guidelines:Client must provide at least one clear and concise visual reference of the character desired; please supplement the visual reference with any important information I may need to know to correctly draw the character.
If you link to a gallery of your character’s artwork, I cannot promise your design will be done with 100% accuracy. Design interpretations may be inconsistent between images and lessen my ability to accurately draw your character. Shading on potential pieces will also play a part in this. If at all possible please provide an unshaded piece of work so I can accurately represent colors.SECTION IV. WILL/WON'T DRAWBelow is a general guideline for what I will or will not draw. Please keep my art style in mind when ordering; If requested I can attempt to draw in a different style than my own, however I cannot grantee that it'll be 100% accurate to the source material.Allowed ContentHumansMonstersComplicated DesignsComplicated ClothesAnthro-Gore (Depending on level, DM for clarification)-Semi-NSFW (must be 18+)-NSFW (must be 18+)Disallowed ContentCharacters intended to be or appear underage in any sexual or suggestive context.Extreme Fetishes (Ask for clarification)Any sort of hateful content, such as racism, transphobia, homophobia, and characters with Nazi/Soviet/etc. imagery or paraphernalia.You must be over the age of 18 to commission adult content. I am a United States citizen and abide by United States laws. Breaking this rule is extremely serious and will result in blacklisting/blocking on all social media, email, and any other means of contact. By ordering anything 18+/NSFW you are agreeing that you are at or above the age of 18. Confirmation via a Legal ID may be required to confirm to myself that you are in fact legally an adult, if I require verification, you are encouraged to block out your face, legal name, or any personal information, all I need to see is your birthdate to verify that you are an adult. If asked for some sort of confirmation, and if this request is refused, I will not take the commission. I wont ask unless I have reason to believe that you may not be an adult. You will not be placed on my blacklist for regular work, but you will no longer be able to commission NSFW art from me. If you are found to not be an adult, and lied specifically to obtain nsfw content from me, you will be permanently blacklisted from commissioning me in the future for any commissions.SECTION V. WORKFLOW PROCESSI work best when given some artistic freedom to create an image based on the characters you provide, but if you have something specific in mind, I am more than capable to conform to your needs.If there are any delays in completion of a commission, I will personally notify the client.Completion for each commission will vary based on complexity, So it can take anywhere from a couple days to a month, But I will keep you as the client as updated as I can, and if you ever want updates you are more than welcome to dm me at anytime and I'll get back to you within 1-3 business days at most. Timelines can shift based on how many clients I have at the time, what's going on in my personal life,I do work a "normal" job so it does cut into my commissions a lil bit, but I work on commissions as much as I can physically without experiencing burnout. For the fastest turn out time, please be a lil patient with me, and please dont hesitate to ask for updates! I promise its not an issue, and I'll get back to you with updates as soon as possible.There are times where I will work on commissions while streaming. If you do not want me to stream working on your commission, I require notice, as well as I require an extra $20.Works in Progress (WIPS): All commission types include a sketch approval stage. I will send any wips to the commissioner if asked, or If I do anything significant to change or alter an artwork regardless of an update request. Progress will be paused until the sketch is confirmed.Revisions and edits: Any major changes or revisions must be made at the Sketch stage; this includes any significant changes to a character’s pose, body shape, or redrawing parts of the image.After the sketch has been approved, no major edits or changes will be made to the pose or the character. If the commissioner requests additional major edits after the approved sketch, a price for the edits may be discussed for said changes.If I, the artist, make any errors in the character design, accessories, or any other visual elements specified in the provided visual references, I will make these edits at no additional cost.--------------------------------------------------------------------------------------------------
